New Legislation On Smoking!

Good news for those who loathe cancer victims…

Two pieces of legislation that dramatically increase smoking fines and crack down on tobacco companies have been signed into law!

The acts include the following:

* It is now illegal for adults to smoke in a car where there is a child under 12 years of age.

* Fines up to a maximum of R50,000 will be handed to owners of a restaurant, pub, bar or workplace who breach the smoking laws  and R500 for the individual smoker.

* Smoking is now illegal in "partially enclosed" public places such as covered patios, verandas, balconies, walkways and parking areas.

* Smoking is not permitted on premises, including private homes, used for commercial childcare activities, or for schooling or tutoring.

* The tobacco industry is no longer permitted to hold "parties" or use "viral" marketing to target young people.

* The sale of tobacco products to and by people under 18 years is prohibited, as is the sale of confectionery or toys resembling tobacco products.

* Also in the pipeline are rules to keep smoking away from entrances to buildings, and restrict it in sports stadiums, railway platforms, bus stops as well as outdoor dining areas.

In addition, the way has been paved for dramatic picture warnings such as diseased lungs on cigarette packs.

With tobacco killing 44,000 South Africans every year, three times more than vehicle accidents, this seems like the perfect tactic to help resolve a clearly increasing problem.

Excellent news. Just hope it will be seen through to where it is illegal to smoke anywhere. You not only damage your own lungs but those of the people around you, mostly those you love the most.

May B they should stop wasting money on the "laws of smoking in cars etc" and pay more attention to those driving unroadworthy vehicles and without licence!!! , who are more of a threat to us "road users" thant anything else.....

all good and well that they ban smoking in public places, but cars are not public places, agree with Lindy that the government should clamp down more on people driving illegally without licences, unroadworthy vehicles and driving drunk. with all the pollution on the roads a couple of puffs of cigarette will hardly make a difference to the person driving with their window open.

My mother and grandmother died of cancer, BUT, in my profession, I have seen more homes destroyed by alcohol abuse, road accidents and families destroyed by the lovely beer and whiskey that is so lavishly advertised - and I have never heard of a man beating up his wife because he smoked a cigarette! Wake up, sheep-people! Cigarettes are harmless in comparison to alcohol use, unless we all wear gas masks to filter out the air pollution too - let's clamp down on alcohol consumption rather, and the world will be a much safer place.

I smoke, when I am at home, I smoke outside. I am a well behaved smoker, but if I look at the money that goes into anti-smoking laws, and we pay a lot of the taxes, I wonder if we are getting an apple that is shiney outside and rotten inside. I can not afford to go buy a car over a million, yet my smoking probably paid for a lot of it?

I am a smoker as well, most of the people have a lot to say about smokers but , what a about alchol abuse, road accididents, they have not a lot to say about them, we are always the ones that needs to be cursed - i now its a bad habbit, but smoking does not broke up marriages but alchol does, i think they must bring in a new legislation on Alchol as well.

When going out to dinner, if there is no smoking area for me, I leave and go elsewhere. Also, why must we be stuck out in the cold on a park bench when other diners are sitting comfortably at decent tables, my money is just as good as the non-smokers! How about looking at the alcohol problem and leave us to puff in peace.

i have given up smoking for a year now using an electronic cigarette. There is no smoke only vapour so there is no smell at all. Go to www.ciglit.com and have a look at the cigarette which is being sold in PE. It works! a lot of my friends have either stopped completedly with this method or changed over to the electronic cigarette altogether. Their smokers cough has stopped and there are no dirty ash trays to clean out anymore!

While I agree that there needs to be a lot more done iro the alcohol abuse in our country and the havoc that causes - I am also 100% behind anything that is done to erradicate smoking. It is a filthy habit. The other day I was in a lift and a lovely young girl entered. Anticipating a nice perfumed smell, she reeked of smoking odours.....It is truely disgsuting - ageing you and killing you as well. To all the young people out there - stop it - you will age better, smell better and live longer and healthier lives.

Because I am desparate for a salary, I am forced to work in a smoking environment. My eyes water, my asthma is chronic and have upper respiritory infection. Hate the way I feel and smell when I walk out of the building but need the monthly salary cheque. Maybe the smokers should Google what effect second hand smoke has on others, especially children!! Smoking is a disgusting, selfish and harmful habit. All smokers smell bad and destroy the people around them. Smokers should book themselves into rehab, along with the druggies and alchoholics, there is no difference, they are just as pathetic - they are addicted and threaten the lives of others around them. Good for the new laws. Nail the smokers.

I agrrrrrrree that smoking in public places must stop and all smoking in the vicinity of non-smoking minors MUST be outlawed. I do believe that Restuarants and pubs should be allowed to have a cordoned-off area where one can eat and enjoy a smoke, if you so desire - smokers money is as good as non-smokers. Yes smokers do not smell good and they age more than non-smokers, but it is their choice and if they lose out on good smelling company and don't get lucky so be it. Leave the smokers alone, there are far more important issues in our country that needs to be addressed. Over 1000 schools in the Eastern Cape do not have water or sanitation or the classrooms are so derelict that no tuition of value can take place in them. Just one area to look at.

So they introduce more anti smoking legislation and with it more stiff fines.For petes sake,who are they trying to scare.Adults still send their under sixteen kids to buy smokes at the shop or spaza shop and primary school kids and the under sixteens at high schools still smoke,even in school uniform.I have seen these transgressions and the law as usual is toothless as usual.Unless under age smoking,like drinking,is brought under control,this so called government of ours will be passing bills and making new ones until the cows come home.

What I would like to know is what happened to being treated equally? Why should a smoker be treated differently than a non-smoker. What makes them different than us? I think that the new law is not acceptable..... Everyone has their own human rights, and should be treated accordingly.

Jakkie you say what about being treated equally i agree. what about freedom of trade the new smoking law is going to put thousands of people out of jobs the pubs cannot afford to give 75% of their space to non smokers when 95% of their clients are smokers. The smoking clients refuse to go to a pub where they cant smoke. On any given day at any given time they send 20 police officers into a pub to see if their clients are smoking, how many people are being hijacked, raped, killed in the hour that the 20 police officers are worrying about smoking?? When you turn 18 you are allowed to go in to debt, so by law you are aloud to make decisions about your well being, so why cant yo make the decision if you are going to a smoking bar. I agree with the new law it should just make more room for smokers in pubs and clubs.

I work in a restuarant which has a verandah with a roof and its used as a smoking area.There is also an open area up on yhe deck which is used for smoking too.My concern is that under the new legistlation smoking is banned in such common areas.How do i report such an offence
